Who we are

Growthy (“Growthy”, “we”, “us”) operates the service at growthyagent.com. These terms are the agreement between us and the business that subscribes (“you”). By subscribing you accept them.

The service

Growthy is an AI agent that performs online work for your business on your instruction, sent by text. Depending on the pieces you subscribe to, that includes making and running ads, replying to missed calls, following up on quotes, asking for and answering reviews, sending campaigns to your list, handling renewals, setting and reminding appointments, and keeping your CRM tidy. On the whole-system plan you can ask it to do anything else that is done online.

Growthy acts on your behalf, not on its own judgment about your business. It asks before it does anything new that goes out under your name, and you can tell it to stop at any time by texting it.

Your account

You must own the business you sign up, or be authorized to act for it, and you must be authorized to connect every account you give Growthy access to — your Google Business profile, ad accounts, calendar, CRM, phone number and anything else. You are responsible for what happens under your accounts and for keeping your own logins secure. You must be at least 18 years old.

Subscriptions and billing

Subscriptions are monthly and billed in advance by Stripe, our payment processor. We never see or store your card details. Your plan renews automatically each month until you cancel, and you can cancel anytime from the billing portal link in your receipt. Cancellation stops the next renewal; the month you have already paid for runs to its end. Refunds are covered by our refund policy.

The founding price is $99/mo for the whole system for the first 50 businesses. It stays at that price for as long as you remain continuously subscribed, whatever we charge later. If you cancel and come back, you pay the price in effect when you return. Taxes may be added where required.

Acceptable use

You may not use Growthy for anything unlawful, deceptive, or abusive. That includes sending messages to people who have not agreed to hear from you, sending unsolicited bulk messages, impersonating someone else, running misleading advertising, or asking for reviews in exchange for payment. You are responsible for having consent to message your customers and for following the rules of the platforms you connect, including the messaging and advertising rules that apply to your industry and your location.

We may pause or end an account that breaks these rules, that puts our messaging or advertising accounts at risk, or that we are required to stop serving.

What we do

We act on your instructions, keep your business in its own workspace, and tell you plainly when we cannot do something you have asked for. We do not guarantee any particular result: how many jobs you book depends on your market, your prices, your capacity and your reputation, and none of those are ours to control.

Growthy depends on services we do not control, such as Google, Meta, your calendar and your phone carrier. When one of them changes or goes down, parts of the service can stop working until it is fixed.

Limitation of liability

The service is provided as-is, without warranties of any kind, to the extent the law allows. We are not liable for indirect, incidental or consequential damages, or for lost profits or lost business. Our total liability for any claim is capped at the fees you paid us in the three months before the claim arose. Nothing here limits liability that cannot be limited by law.

Changes

We may update these terms. When a change is material, we email you at least 14 days before it takes effect, so you can cancel first if you disagree. Continuing to use Growthy after that date means you accept the new terms.
